Article L221-21 of the French Monetary and Financial Code

Establishments managing people’s savings plans which are unable to produce the supporting documents provided for in the contract within three months of a request from the relevant departments or supervisory bodies must repay to the State the premiums for which the supporting documents are missing, together with their capitalised interest.

These provisions apply to agreements signed by these establishments with the State before 1 January 1997 for sums paid from 1 January 1997.

Article L221-21

Les établissements gestionnaires de plans d’épargne populaire, qui seraient dans l’incapacité de produire les pièces justificatives prévues contractuellement dans un délai de trois mois à compter de la demande formulée par les services ou les corps de contrôle compétents, devront reverser à l’Etat les primes pour lesquelles les pièces justificatives font défaut, ainsi que leurs intérêts capitalisés.

Ces dispositions s’appliquent aux conventions signées par ces établissements avec l’Etat avant le 1er janvier 1997 pour les sommes versées à compter du 1er janvier 1997.
