Article L2214-4 of the French General Code of Local Authorities

The responsibility for repressing breaches of the public peace, as defined in 2° of article L. 2212-2 and placed by that article as a general rule in the hands of the mayor, falls to the State alone in communes where the police are state-run, except in the case of neighbourhood disturbances.

In these same communes, the State is responsible for good order when there are occasional large gatherings of men.

All the other police powers listed in articles L. 2212-2, L. 2212-3 and L. 2213-9 are exercised by the mayor, including the maintenance of good order at fairs, markets, public celebrations and ceremonies, shows, games, cafés, churches and other public places.

Le soin de réprimer les atteintes à la tranquillité publique, tel qu’il est défini au 2° de l’article L. 2212-2 et mis par cet article en règle générale à la charge du maire, incombe à l’Etat seul dans les communes où la police est étatisée, sauf en ce qui concerne les troubles de voisinage.

Dans ces mêmes communes, l’Etat a la charge du bon ordre quand il se fait occasionnellement de grands rassemblements d’hommes.

Tous les autres pouvoirs de police énumérés aux articles L. 2212-2, L. 2212-3 et L. 2213-9 sont exercés par le maire y compris le maintien du bon ordre dans les foires, marchés, réjouissances et cérémonies publiques, spectacles, jeux, cafés, églises et autres lieux publics.
