Article L2232-29 of the French Labour Code

Negotiations between the employer and the members of the staff delegation of the social and economic committee, with or without mandate, or the employees of the company with mandate, take place in compliance with the following rules:

1° Independence of the negotiators vis-à-vis the employer ;

2° Joint preparation of the draft agreement by the negotiators;

3° Consultation with employees;

4° Ability to contact representative trade union organisations in the sector.

In addition, the information to be given to the members of the delegation of the person of the social and economic committee, whether mandated or not, or to the mandated employees prior to the negotiation, is determined by agreement between them and the employer.

Article L2232-29

La négociation entre l’employeur et les membres de la délégation du personnel du comité social et économique, mandatés ou non, ou les salariés de l’entreprise mandatés se déroule dans le respect des règles suivantes :

1° Indépendance des négociateurs vis-à-vis de l’employeur ;

2° Elaboration conjointe du projet d’accord par les négociateurs ;

3° Concertation avec les salariés ;

4° Faculté de prendre l’attache des organisations syndicales représentatives de la branche.

Par ailleurs, les informations à remettre aux membres de la délégation du personne du comité social et économique, mandatés ou non, ou aux salariés mandatés préalablement à la négociation sont déterminées par accord entre ceux-ci et l’employeur.
