Article L2241-3 of the French General Code of Local Authorities

When the communes and their public establishments make amicable property acquisitions in accordance with the rules of civil law, or when the acquisition takes place by auction, the notary drafting the deed shall, if necessary, proceed, under his responsibility, to purge all liens and mortgages.

The funds remitted to him are then considered to have been received by reason of his functions.

Lorsque les communes et leurs établissements publics procèdent à des acquisitions immobilières à l’amiable suivant les règles du droit civil, ou lorsque l’acquisition a lieu sur licitation, le notaire rédacteur de l’acte procède s’il y a lieu, sous sa responsabilité, à la purge de tous privilèges et hypothèques.

Les fonds qui lui sont remis sont alors considérés comme reçus en raison de ses fonctions.
