Article L2241-5 of the French General Code of Local Authorities

Deliberations by which the administrative boards responsible for the management of communal public establishments change in whole or in part the allocation of premises or immovable or movable objects belonging to these establishments, in the interest of any public or private service, or make these premises and objects available, either to another public or private establishment, or to a private individual, are enforceable only after the agreement of the town council.

Deliberations by which the boards of directors of public communal accommodation establishments for the elderly decide on the allocation of buildings are governed by article L. 315-12 of the Code de l’action sociale et des familles.

Les délibérations par lesquelles les commissions administratives chargées de la gestion des établissements publics communaux changent en totalité ou en partie l’affectation des locaux ou objets immobiliers ou mobiliers appartenant à ces établissements, dans l’intérêt d’un service public ou privé quelconque, ou mettent ces locaux et objets à la disposition, soit d’un autre établissement public ou privé, soit d’un particulier, ne sont exécutoires qu’après accord du conseil municipal.

Les délibérations par lesquelles les conseils d’administration des établissements publics communaux d’hébergement des personnes âgées se prononcent sur l’affectation des immeubles sont régies par l’article L. 315-12 du code de l’action sociale et des familles.
