Article L2241-6 of the French General Code of Local Authorities

When the mayor conducts a public auction on behalf of the municipality, he is assisted by two members of the municipal council designated in advance by the council or, in the absence of such designation, called in the order of the roll.

The municipal collector is called to all auctions.

Any difficulties that may arise over the preparatory operations of the auction are resolved, sitting in camera, by the mayor and the two assistants, by a majority of votes, barring legal appeal.

Lorsque le maire procède à une adjudication publique pour le compte de la commune, il est assisté de deux membres du conseil municipal désignés d’avance par le conseil ou, à défaut de cette désignation, appelés dans l’ordre du tableau.

Le receveur municipal est appelé à toutes les adjudications.

Toutes les difficultés qui peuvent s’élever sur les opérations préparatoires de l’adjudication sont résolues, séance tenante, par le maire et les deux assistants, à la majorité des voix, sauf le recours de droit.
