Article L2261-18 of the French Labour Code

When a branch agreement has not been the subject of an amendment or appendix for at least five years or, in the absence of an agreement, it has not been possible to conclude agreements for at least five years, this situation may be assimilated to the case of absence or default of the organisations within the meaning of article L. 2261-17 and give rise to the application of the procedure provided for in that article.

Lorsqu’une convention de branche n’a pas fait l’objet d’avenant ou annexe pendant cinq ans au moins ou, qu’à défaut de convention, des accords n’ont pu y être conclus depuis cinq ans au moins, cette situation peut être assimilée au cas d’absence ou de carence des organisations au sens de l’article L. 2261-17 et donner lieu à l’application de la procédure prévue à cet article.
