Article L2261-25 of the French Labour Code

The Minister of Labour may exclude from extension, after a reasoned opinion has been given by the National Commission for Collective Bargaining, any clauses that conflict with legal provisions. The Minister may also refuse to extend a collective agreement on grounds of general interest, in particular on the grounds that it is excessively detrimental to free competition or to employment policy objectives.

It may also exclude clauses that can be severed from the agreement without altering its structure, but which do not meet the needs of the industry or industries in the scope in question.

It may, under the same conditions, extend, subject to the application of the legal provisions, clauses which are incomplete with regard to these provisions.

It may, under the same conditions, extend clauses calling for additional stipulations in the agreement or arrangement, making their entry into force subject, unless otherwise provided by law, to the existence of a company agreement providing for such stipulations.

Le ministre chargé du travail peut exclure de l’extension, après avis motivé de la Commission nationale de la négociation collective, les clauses qui seraient en contradiction avec des dispositions légales. Il peut également refuser, pour des motifs d’intérêt général, notamment pour atteinte excessive à la libre concurrence ou au regard des objectifs de la politique de l’emploi, l’extension d’un accord collectif.

Il peut également exclure les clauses pouvant être distraites de la convention ou de l’accord sans en modifier l’économie, mais ne répondant pas à la situation de la branche ou des branches dans le champ d’application considéré.

Il peut, dans les mêmes conditions, étendre, sous réserve de l’application des dispositions légales, les clauses incomplètes au regard de ces dispositions.

Il peut, dans les mêmes conditions, étendre les clauses appelant des stipulations complémentaires de la convention ou de l’accord, en subordonnant, sauf dispositions législatives contraires, leur entrée en vigueur à l’existence d’une convention d’entreprise prévoyant ces stipulations.
