Article L2261-3 of the French Labour Code

Any representative trade union organisation of employees and any trade union organisation or association of employers or individual employers may join an agreement.

However, if the activity in which they or their members engage does not fall within the scope of the agreement, their membership is subject to the provisions of articles L. 2261-5 or L. 2261-6, as applicable.

Membership is notified to the signatories of the convention or agreement and is filed in accordance with the conditions laid down by regulation, at the request of its author(s).

Article L2261-3

Peuvent adhérer à une convention ou à un accord toute organisation syndicale représentative de salariés ainsi que toute organisation syndicale ou association d’employeurs ou des employeurs pris individuellement.

Toutefois, si l’activité qu’ils exercent ou qu’exercent leurs adhérents n’entre pas dans le champ d’application de la convention ou de l’accord, leur adhésion est soumise aux dispositions des articles L. 2261-5 ou L. 2261-6, selon le cas.

L’adhésion est notifiée aux signataires de la convention ou de l’accord et fait l’objet d’un dépôt dans des conditions prévues par voie réglementaire, à la diligence de son ou de ses auteurs.
