Article L2261-33 of the French Labour Code

In the event of a merger of the scope of application of several collective agreements in application of I of article L. 2261-32 or in the event of the conclusion of a collective agreement combining the scope of several existing agreements, the contractual stipulations applicable prior to the merger or combination, where they govern equivalent situations, are replaced by common stipulations, within a period of five years from the effective date of the merger or combination. During this period, the branch resulting from the grouping or merger may maintain several collective agreements.

In view of the general interest attached to the restructuring of professional branches, temporary differences in treatment between employees resulting from the merger or regrouping may not be usefully invoked during the period mentioned in the first paragraph of this article.

In the absence of an agreement reached within this period, the stipulations of the collective agreement of the relevant branch shall apply.

Article L2261-33

En cas de fusion des champs d’application de plusieurs conventions collectives en application du I de l’article L. 2261-32 ou en cas de conclusion d’un accord collectif regroupant le champ de plusieurs conventions existantes, les stipulations conventionnelles applicables avant la fusion ou le regroupement, lorsqu’elles régissent des situations équivalentes, sont remplacées par des stipulations communes, dans un délai de cinq ans à compter de la date d’effet de la fusion ou du regroupement. Pendant ce délai, la branche issue du regroupement ou de la fusion peut maintenir plusieurs conventions collectives.

Eu égard à l’intérêt général attaché à la restructuration des branches professionnelles, les différences temporaires de traitement entre salariés résultant de la fusion ou du regroupement ne peuvent être utilement invoquées pendant le délai mentionné au premier alinéa du présent article.

A défaut d’accord conclu dans ce délai, les stipulations de la convention collective de la branche de rattachement s’appliquent.
