Article L2312-15 of the French Labour Code

The social and economic committee issues opinions and wishes in the exercise of its consultative powers.

To this end, it has sufficient time for examination and precise written information sent or made available by the employer, as well as the employer’s reasoned response to its own observations.

It also has access to relevant information held by public administrations and bodies acting on their behalf, in accordance with the legal provisions relating to access to administrative documents.

If the Committee considers that it does not have sufficient information, it may refer the matter to the President of the Court of First Instance, ruling under the accelerated procedure on the merits, so that he may order the employer to provide the missing information.

This referral does not have the effect of extending the period within which the committee must give its opinion. However, in the event of particular difficulties in accessing the information required to formulate the committee’s reasoned opinion, the judge may decide to extend the period provided for in the second paragraph.

The employer shall give an account of the action taken on the committee’s opinions and wishes, stating the reasons therefor.

Le comité social et économique émet des avis et des vœux dans l’exercice de ses attributions consultatives.

Il dispose à cette fin d’un délai d’examen suffisant et d’informations précises et écrites transmises ou mises à disposition par l’employeur, et de la réponse motivée de l’employeur à ses propres observations.

Il a également accès à l’information utile détenue par les administrations publiques et les organismes agissant pour leur compte, conformément aux dispositions légales relatives à l’accès aux documents administratifs.

Le comité peut, s’il estime ne pas disposer d’éléments suffisants, saisir le président du tribunal judiciaire statuant selon la procédure accélérée au fond, pour qu’il ordonne la communication par l’employeur des éléments manquants.

Cette saisine n’a pas pour effet de prolonger le délai dont dispose le comité pour rendre son avis. Toutefois, en cas de difficultés particulières d’accès aux informations nécessaires à la formulation de l’avis motivé du comité, le juge peut décider la prolongation du délai prévu au deuxième alinéa.

L’employeur rend compte, en la motivant, de la suite donnée aux avis et vœux du comité.
