Article L2312-18 of the French Labour Code

An economic, social and environmental database brings together all the information required for consultations and recurring information that the employer makes available to the social and economic committee. This information includes, in particular, all the indicators relating to professional equality between men and women, notably on the differences in remuneration and distribution between men and women among senior executives and members of the management bodies defined in article L. 23-12-1 of the French Commercial Code, and information on the methodology and content of the indicators provided for in article L. 1142-8 of this code.

The information transmitted to the Committee on a recurring basis is made available to its members in the database and this updated availability is deemed to constitute communication of the reports and information to the Committee, under the conditions and within the limits set by a decree of the Conseil d’Etat.

Where the provisions of this code also provide for the transmission to the administrative authority of the reports and information mentioned in the second paragraph, the information they contain is made available to the administrative authority from the database and the updated information is deemed to have been transmitted to this authority.

Article L2312-18

Une base de données économiques, sociales et environnementales rassemble l’ensemble des informations nécessaires aux consultations et informations récurrentes que l’employeur met à disposition du comité social et économique. Ces informations comportent en particulier l’ensemble des indicateurs relatifs à l’égalité professionnelle entre les femmes et les hommes, notamment sur les écarts de rémunération et de répartition entre les femmes et les hommes parmi les cadres dirigeants et les membres des instances dirigeantes définies à l’article L. 23-12-1 du code de commerce, et les informations sur la méthodologie et le contenu des indicateurs prévus à l’article L. 1142-8 du présent code.

Les éléments d’information transmis de manière récurrente au comité sont mis à la disposition de leurs membres dans la base de données et cette mise à disposition actualisée vaut communication des rapports et informations au comité, dans les conditions et limites fixées par un décret en Conseil d’Etat.

Lorsque les dispositions du présent code prévoient également la transmission à l’autorité administrative des rapports et informations mentionnés au deuxième alinéa, les éléments d’information qu’ils contiennent sont mis à la disposition de l’autorité administrative à partir de la base de données et la mise à disposition actualisée vaut transmission à cette autorité.
