Article L2312-55 of the French Labour Code

A company agreement, concluded under the conditions provided for in the first paragraph of article L. 2232-12 or, in the absence of a trade union delegate, an agreement between the employer and the social and economic committee, adopted by a majority of the full members of the committee’s staff delegation may define:

1° The content of the ad hoc consultations and information of the social and economic committee provided for in articles L. 2312-8 and L. 2312-37 in compliance with the provisions of paragraph 1 of this sub-section;

2° The procedures for these ad hoc consultations, in particular the number of meetings;

3° The deadlines mentioned in article L. 2312-15 within which the committee’s opinions are issued.

Un accord d’entreprise, conclu dans les conditions prévues au premier alinéa de l’article L. 2232-12 ou, en l’absence de délégué syndical, un accord entre l’employeur et le comité social et économique, adopté à la majorité des membres titulaires de la délégation du personnel du comité peut définir :


1° Le contenu des consultations et informations ponctuelles du comité social et économique prévues aux articles L. 2312-8 et L. 2312-37 dans le respect des dispositions du paragraphe 1 de la présente sous-section ;


2° Les modalités de ces consultations ponctuelles, notamment le nombre de réunions ;


3° Les délais mentionnés à l’article L. 2312-15 dans lesquels les avis du comité sont rendus.
