Article L2313-5 of the French Labour Code

In the event of a dispute concerning the employer’s decision provided for in article L. 2313-4, the number and perimeter of the separate establishments are set by the administrative authority of the company’s registered office under conditions laid down by decree in the Conseil d’Etat. When the referral to the administrative authority is made as part of an overall electoral process, it suspends this process until the administrative decision is taken and extends the term of office of the elected representatives until the results of the ballot are announced.

The decision of the administrative authority may be appealed to the judicial judge, to the exclusion of any other administrative or contentious appeal.

En cas de litige portant sur la décision de l’employeur prévue à l’article L. 2313-4, le nombre et le périmètre des établissements distincts sont fixés par l’autorité administrative du siège de l’entreprise dans des conditions prévues par décret en Conseil d’Etat. Lorsqu’elle intervient dans le cadre d’un processus électoral global, la saisine de l’autorité administrative suspend ce processus jusqu’à la décision administrative et entraine la prorogation des mandats des élus en cours jusqu’à la proclamation des résultats du scrutin.

La décision de l’autorité administrative peut faire l’objet d’un recours devant le juge judiciaire, à l’exclusion de tout autre recours administratif ou contentieux.
