Article L2315-24 of the French Labour Code

The Social and Economic Committee shall determine, in its internal regulations, the terms and conditions of its operation and of its relations with the employees of the undertaking, for the performance of the duties conferred upon it by Chapter II of this Title.

Except with the agreement of the employer, the internal regulations may not contain clauses imposing on it obligations which do not result from legal provisions. This agreement constitutes a unilateral undertaking by the employer, which may be terminated after a reasonable period of time and after informing the members of the staff delegation of the Social and Economic Committee.

Le comité social et économique détermine, dans un règlement intérieur, les modalités de son fonctionnement et celles de ses rapports avec les salariés de l’entreprise, pour l’exercice des missions qui lui sont conférées par le chapitre II du présent titre.

Sauf accord de l’employeur, un règlement intérieur ne peut comporter des clauses lui imposant des obligations ne résultant pas de dispositions légales. Cet accord constitue un engagement unilatéral de l’employeur que celui-ci peut dénoncer à l’issue d’un délai raisonnable et après en avoir informé les membres de la délégation du personnel du comité social et économique.
