Article L2315-7 of the French Labour Code

The employer allows the time required to carry out their duties:

1° To each of the full members of the staff delegation of the social and economic committee;

2° To the union representatives on the social and economic committee in undertakings with at least five hundred and one employees;

3° To the union representatives on the central social and economic committee of the undertaking in undertakings with at least five hundred and one employees where none of the separate establishments reaches this threshold.

The number of delegation hours for the representatives mentioned in 1° to 3°, set by decree by the Conseil d’Etat according to both the number of employees in the undertaking or establishment and the number of delegation members, may not be less than ten hours per month in undertakings with fewer than fifty employees and sixteen hours in other undertakings.

Article L2315-7

L’employeur laisse le temps nécessaire à l’exercice de leurs fonctions :

1° A chacun des membres titulaires constituant la délégation du personnel du comité social et économique ;

2° Aux représentants syndicaux au comité social et économique dans les entreprises d’au moins cinq cent un salariés ;

3° Aux représentants syndicaux au comité social et économique central d’entreprise dans les entreprises d’au moins cinq cent un salariés dont aucun des établissements distincts n’atteint ce seuil.

Le nombre d’heures de délégation des représentants mentionnés aux 1° à 3°, fixé par décret en Conseil d’Etat en fonction à la fois des effectifs de l’entreprise ou de l’établissement et du nombre de membres de la délégation, ne peut être inférieur à dix heures par mois dans les entreprises de moins de cinquante salariés et à seize heures dans les autres entreprises.
