Article L232-23 of the French Sports Code

I. – The Sanctions Committee of the French Anti-Doping Agency may impose the following sanctions on persons who have breached the provisions of Articles L. 232-9, L. 232-9-1, L. 232-9-2, L. 232-9-3, L. 232-10, L. 232-10-3, L. 232-10-4 or L. 232-17:

1° A warning;

2° A temporary or permanent suspension:

a) From taking part, in any capacity whatsoever, in a competition authorised or organised by a signatory organisation of the World Anti-Doping Code or one of its members, by a professional league or an organisation responsible for non-signatory international or national events, by a sports federation, or giving rise to the award of prizes in money or in kind;

b) Take part in any activity, including training, clinics or exhibitions, authorised or organised by an organisation that is a signatory to the World Anti-Doping Code or one of its members, by a professional league or an organisation responsible for non-signatory international or national events, or by a sports federation, a professional league or one of their members, unless these activities are part of recognised education or rehabilitation programmes related to the fight against doping;

c) To exercise the functions of management staff or any administrative activity within a sports federation, a professional league, an organisation that is a signatory to the World Anti-Doping Code or one of their members;

d) And from taking part in any sporting activity involving national or international level athletes and financed by a public entity.

Where justified by the circumstances and the seriousness of the violation, the Disciplinary Board of the Sanction Commission may issue a ban on exercising the functions defined in article L. 212-1.

The sanction imposed on an athlete may be supplemented by a fine of up to €45,000. The sanction imposed on any other person who has breached the provisions of article L. 232-10 may be supplemented by a financial penalty of up to €150,000.

The financial penalty provided for in the previous paragraph may only be applied when the person concerned has been suspended for the maximum period provided for in this article.

II. – (Repealed)

III. – The proceeds of the pecuniary penalties provided for in the present article shall be recovered in the same way as State debts other than taxes and property.

I. – La commission des sanctions de l’Agence française de lutte contre le dopage peut prononcer à l’encontre des personnes ayant enfreint les dispositions des articles L. 232-9, L. 232-9-1, L. 232-9-2, L. 232-9-3, L. 232-10, L. 232-10-3, L. 232-10-4 ou L. 232-17 :

1° Un avertissement ;

2° Une suspension temporaire ou définitive :

a) De participer, à quelque titre que ce soit, à une compétition autorisée ou organisée par une organisation signataire du code mondial antidopage ou l’un de ses membres, par une ligue professionnelle ou une organisation responsable de manifestations internationales ou nationales non signataires, par une fédération sportive, ou donnant lieu à remise de prix en argent ou en nature ;

b) De participer à toute activité, y compris les entraînements, stages ou exhibitions, autorisée ou organisée par une organisation signataire du code mondial antidopage ou l’un de ses membres, par une ligue professionnelle ou une organisation responsable de manifestations internationales ou nationales non signataires, ou par une fédération sportive, une ligue professionnelle ou l’un de leurs membres, à moins que ces activités ne s’inscrivent dans des programmes reconnus d’éducation ou de réhabilitation en lien avec la lutte contre le dopage ;

c) D’exercer les fonctions de personnel d’encadrement ou toute activité administrative au sein d’une fédération sportive, d’une ligue professionnelle, d’une organisation signataire du code mondial antidopage ou de l’un de leurs membres ;

d) Et de prendre part à toute activité sportive impliquant des sportifs de niveau national ou international et financée par une personne publique.

Lorsque les circonstances et la gravité de la violation le justifient, la formation disciplinaire de la commission des sanctions peut prononcer l’interdiction d’exercer les fonctions définies à l’article L. 212-1.

La sanction prononcée à l’encontre d’un sportif peut être complétée par une sanction pécuniaire dont le montant ne peut excéder 45 000 €. Celle prononcée à l’encontre de toute autre personne qui a enfreint les dispositions de l’article L. 232-10 peut être complétée par une sanction pécuniaire dont le montant ne peut excéder 150 000 €.

La sanction pécuniaire prévue à l’alinéa précédent ne peut être appliquée que lorsque l’intéressé s’est vu infliger la durée maximale encourue de la suspension prévue au présent article.

III. – Le produit des sanctions pécuniaires prévues au présent article est recouvré comme les créances de l’Etat étrangères à l’impôt et au domaine.
