Article L2332-2 of the French Labour Code

In the event of a takeover bid being announced for the dominant undertaking in a group, the employer of that undertaking shall immediately inform the group works council. The provisions set out in articles L. 2323-35 to L. 2323-39 for the social and economic committee are then applied at group committee level.

Compliance with these provisions waives the obligations set out in articles L. 2323-26 to L. 2323-44 for the social and economic committees of the companies belonging to the group.

Article L2332-2

En cas d’annonce d’offre publique d’acquisition portant sur l’entreprise dominante d’un groupe, l’employeur de cette entreprise en informe immédiatement le comité de groupe. Sont alors appliquées, au niveau du comité de groupe, les dispositions prévues aux articles L. 2323-35 à L. 2323-39 pour le comité social et économique.

Le respect de ces dispositions dispense des obligations définies aux articles L. 2323-26 à L. 2323-44 pour les comités sociaux et économiques des sociétés appartenant au groupe.
