After constitution of the quota for the benefit of the territorial constituencies of Wallis and Futuna, the communes as well as the groupings of communes of the overseas collectivities and New Caledonia mentioned in Article L. 2334-34, the appropriations for the dotation d’équipement des territoires ruraux are divided between the départements:
1° For 50% of the total amount of the dotation:
a) 50% on the basis of the combined population of communes characterised as sparsely populated or very sparsely populated, as defined by the Institut national de la statistique et des études économiques, on 1 January of the year preceding the year in respect of which the allocation is made, located in public establishments of inter-communal cooperation with their own tax status meeting the eligibility criteria indicated in 1° of article L. 2334-33 and which have their registered office in the department;
b) 50% on the basis of the ratio, for each eligible public inter-municipal cooperation body with its own tax status, between the average per capita tax potential of the public inter-municipal cooperation bodies with their own tax status in its category and its average per capita tax potential;
2° For 50% of the total amount of the allocation:
a) 50% distributed between the départements in proportion to the ratio between the average population density of all the départements and the population density of the département, the ratio taken into account being capped at 10;
b) 50% based on the ratio, for each commune meeting the eligibility criteria indicated in a and b of 2° of Article L. 2334-33, between the average per capita financial potential of all the municipalities belonging to the same demographic group and its average per capita financial potential.
The population to be taken into account for the application of this article is that defined in Article L. 2334-2.
The data used to determine which local authorities are eligible for the dotation d’équipement des territoires ruraux (rural amenities grant) and to allocate the appropriations for this grant relate to the last year preceding the year of allocation.
The amount of the allocation calculated according to the criteria defined in 1° and 2° of this article must be at least equal to 97% or, in the case of overseas departments and Saint-Pierre-et-Miquelon, at least equal to 100%, and at most equal to 103% of the amount of the allocation calculated for the department the previous year.
