I. – A share of the resources of the Fonds national de péréquation des ressources intercommunales et communales (National Fund for the Equalisation of Intercommunal and Communal Resources) is allocated to the communes and public establishments for intercommunal cooperation with their own tax status in the overseas departments, New Caledonia, French Polynesia, the territorial collectivity of Saint-Pierre-et-Miquelon and the territorial constituencies of Wallis and Futuna. This share is calculated by applying to the amount of the resources of the Fonds national de péréquation des ressources intercommunales et communales the ratio, increased by 33%, existing according to the last population census between the population of the overseas departments, New Caledonia, French Polynesia, the territorial collectivity of Saint-Pierre-et-Miquelon and the territorial constituencies of Wallis-et-Futuna and that of the communes in mainland France and the overseas departments, New Caledonia, French Polynesia, the territorial collectivity of Saint-Pierre-et-Miquelon and the territorial constituencies of Wallis-et-Futuna. This share is divided into two envelopes intended, on the one hand, for all the overseas departments with the exception of Mayotte and, on the other hand, for New Caledonia, French Polynesia, the territorial collectivity of Saint-Pierre-et-Miquelon, the territorial constituencies of Wallis and Futuna and the Department of Mayotte, calculated in proportion to the population resulting from the last population census.
II. – The envelope accruing to the municipalities and public establishments for inter-municipal cooperation in the overseas departments, with the exception of Mayotte, is distributed under the conditions provided for in Article L. 2336-5.
For the application of this same Article L. 2336-5, a reference aggregate financial potential and a reference per capita income are calculated for all the inter-municipal groupings and municipalities not belonging to any grouping with its own tax status in the overseas departments, with the exception of Mayotte.
