Article L2345-2 of the French Labour Code

Where a group of undertakings has set up a European Works Council, the agreement referred to in Article L. 2342-2 or an agreement reached within the group may decide to abolish the Group Works Council. The entry into force of the agreement is subject to a favourable vote by the Group Works Council.

If the Group Works Council is abolished, the provisions of articles L. 2332-1, L. 2332-2 and L. 2334-4 apply to the European Works Council.

Article L2345-2

Lorsqu’un groupe d’entreprises a mis en place un comité d’entreprise européen, l’accord mentionné à l’article L. 2342-2 ou un accord passé au sein du groupe peut décider de la suppression du comité de groupe. L’entrée en vigueur de l’accord est subordonnée à un vote favorable du comité de groupe.

En cas de suppression du comité de groupe, les dispositions des articles L. 2332-1, L. 2332-2 et L. 2334-4 sont applicables au comité d’entreprise européen.
