In the absence of an agreement by the special negotiation body on the choice of the form of employee participation, the directors of the companies participating in the cross-border operation determine the form of participation applicable.

The applicable system is always based on the highest proportion or number of members of the administrative or supervisory body concerned by employee participation rights.

A défaut d’accord du groupe spécial de négociation sur le choix de la forme de participation des salariés, les dirigeants des sociétés participant à l’opération transfrontalière déterminent la forme de participation applicable.

Il est toujours retenu, pour la mise en place du système applicable, la proportion ou le nombre le plus élevé de membres de l’organe d’administration ou de surveillance concernés par les droits à participation des salariés.
