Where the applicable form of employee participation consists of recommending or opposing the appointment of members of the administrative or supervisory body, the company committee determines the conditions under which this form of employee participation is exercised.

Where the chosen form of employee participation is election, the procedure is carried out in accordance with Articles L. 225-28 to L. 225-34 and L. 225-80 of the Commercial Code, with the exception of the territoriality requirement set out in the first paragraph of Article L. 225-28.

Lorsque la forme de participation des salariés applicable consiste en la recommandation ou l’opposition à la désignation de membres de l’organe d’administration ou de surveillance, le comité de la société détermine les conditions dans lesquelles s’exerce cette forme de participation des salariés.

Lorsque la forme de participation des salariés choisie consiste en l’élection, la procédure se déroule conformément aux articles L. 225-28 à L. 225-34 et L. 225-80 du code de commerce, exception faite de l’exigence de territorialité prévue au premier alinéa de l’article L. 225-28.
