Article L2411-6 of the French Labour Code

Authorisation to dismiss is required, for a period of six months, for an employee who has asked the employer to organise elections to the social and economic committee or to agree to organise these elections. This period runs from the date of dispatch to the employer of the registered letter by which a trade union organisation was the first to request or agree to elections being held.

This protection applies to only one employee per trade union organisation, as well as to the first employee who has not been mandated by a trade union organisation to request the organisation of elections.

L’autorisation de licenciement est requise, pendant une durée de six mois, pour le salarié ayant demandé à l’employeur d’organiser les élections au comité social et économique ou d’accepter d’organiser ces élections. Cette durée court à compter de l’envoi à l’employeur de la lettre recommandée par laquelle une organisation syndicale a, la première, demandé ou accepté qu’il soit procédé à des élections.

Cette protection ne bénéficie qu’à un seul salarié par organisation syndicale ainsi qu’au premier salarié, non mandaté par une organisation syndicale, qui a demandé l’organisation des élections.
