Article L2411-7 of the French Labour Code

Authorisation for dismissal is required for a period of six months for a candidate, in the first or second round, for the position of elected member of the staff delegation of the social and economic committee, from the date of publication of the candidatures. The six-month period runs from the date on which the application is sent to the employer by registered letter.

This authorisation is also required when the employer has received the trade union’s letter notifying the employer of the candidacy for the position of elected member of the staff delegation of the social and economic committee, or when the employee has proved that the employer was aware of the imminence of his candidacy before the candidate was summoned to the interview prior to dismissal.

L’autorisation de licenciement est requise pendant six mois pour le candidat, au premier ou au deuxième tour, aux fonctions de membre élu de la délégation du personnel du comité social et économique, à partir de la publication des candidatures. La durée de six mois court à partir de l’envoi par lettre recommandée de la candidature à l’employeur.

Cette autorisation est également requise lorsque la lettre du syndicat notifiant à l’employeur la candidature aux fonctions de membre élu à la délégation du personnel du comité social et économique a été reçue par l’employeur ou lorsque le salarié a fait la preuve que l’employeur a eu connaissance de l’imminence de sa candidature avant que le candidat ait été convoqué à l’entretien préalable au licenciement.
