Article L2421-8 of the French Labour Code

For the application of the protection provided for in the last paragraph of articles L. 2412-2, L. 2412-3, L. 2412-4, L. 2412-5, L. 2412-8, L. 2412-9 and L. 2412-13, the expiry of a fixed-term employment contract does not result in its termination until the Labour Inspector, after having been informed in accordance with article L. 2412-1, has established that the employee is not the subject of a discriminatory measure.

The employer must notify the labour inspector before the end of the term.

The Labour Inspector takes a decision before the end of the contract.

Pour l’application de la protection prévue au dernier alinéa des articles L. 2412-2, L. 2412-3, L. 2412-4, L. 2412-5, L. 2412-8, L. 2412-9 et L. 2412-13, l’arrivée du terme du contrat de travail à durée déterminée n’entraîne sa rupture qu’après constatation par l’inspecteur du travail, saisi en application de l’article L. 2412-1, que le salarié ne fait pas l’objet d’une mesure discriminatoire.

L’employeur saisit l’inspecteur du travail avant l’arrivée du terme.

L’inspecteur du travail statue avant la date du terme du contrat.
