Article L2422-4 of the French Labour Code

When the annulment of an authorisation decision has become final, an employee holding one of the mandates referred to in Article L. 2422-1 is entitled to payment of compensation corresponding to the entire loss suffered during the period between his dismissal and his reinstatement, if he has requested this within two months of notification of the decision.

If the employee has not requested reinstatement, the compensation will correspond to the total loss suffered during the period between dismissal and the expiry of the two-month period.

This payment is accompanied by the payment of contributions relating to this compensation, which constitutes additional pay.

Lorsque l’annulation d’une décision d’autorisation est devenue définitive, le salarié investi d’un des mandats mentionnés à l’article L. 2422-1 a droit au paiement d’une indemnité correspondant à la totalité du préjudice subi au cours de la période écoulée entre son licenciement et sa réintégration, s’il en a formulé la demande dans le délai de deux mois à compter de la notification de la décision.
