Article L243-10-1 of the French Labour Code

Breaking the employment contract of an employee included on the list drawn up by the administrative authority referred to in Article L. 1453-4, in disregard of the provisions relating to the administrative authorisation procedure provided for in this book, is punishable by one year’s imprisonment and a fine of €3,750.

Transferring the employment contract of an employee mentioned in the first paragraph of this article as part of a partial transfer of an undertaking or establishment, in disregard of the provisions relating to the administrative authorisation procedure, is punishable by the same penalties.

Le fait de rompre le contrat de travail d’un salarié inscrit sur la liste arrêtée par l’autorité administrative mentionnée à l’article L. 1453-4, en méconnaissance des dispositions relatives à la procédure d’autorisation administrative prévues au présent livre, est puni d’un emprisonnement d’un an et d’une amende de 3 750 €.

Le fait de transférer le contrat de travail d’un salarié mentionné au premier alinéa du présent article dans le cadre d’un transfert partiel d’entreprise ou d’établissement, en méconnaissance des dispositions relatives à la procédure d’autorisation administrative, est puni des mêmes peines.
