Article L2512-2 of the French Labour Code

When the employees mentioned in article L. 2512-1 exercise the right to strike, the concerted cessation of work is preceded by a notice.

The notice shall be issued by a representative trade union organisation at national level, in the professional category or in the company, body or department concerned.

It specifies the reasons for the strike.

The notice must be sent five clear days before the strike is due to start to the hierarchical authority or to the management of the establishment, company or organisation concerned. It shall state the geographical area and time of commencement, as well as the limited or unlimited duration of the planned strike.

During the period of notice, the parties concerned are obliged to negotiate.

Lorsque les personnels mentionnés à l’article L. 2512-1 exercent le droit de grève, la cessation concertée du travail est précédée d’un préavis.

Le préavis émane d’une organisation syndicale représentative au niveau national, dans la catégorie professionnelle ou dans l’entreprise, l’organisme ou le service intéressé.

Il précise les motifs du recours à la grève.

Le préavis doit parvenir cinq jours francs avant le déclenchement de la grève à l’autorité hiérarchique ou à la direction de l’établissement, de l’entreprise ou de l’organisme intéressé. Il mentionne le champ géographique et l’heure du début ainsi que la durée limitée ou non, de la grève envisagée.

Pendant la durée du préavis, les parties intéressées sont tenues de négocier.
