Article L2573-20 of the French General Code of Local Authorities

I.-In their wording resulting from Act No. 2018-1021 of 23 November 2018 on the evolution of housing, development and digital, the articles L. 511-1 to L. 511-5 and article L. 511-6, with the exception of V, of the Construction and Housing Code are applicable to the communes of French Polynesia subject to the adaptations provided for in II, III, IV and V.

II.-.For the application of Article L. 511-1-1 :

1° In the second paragraph, the words: “or, in Paris, Marseille and Lyon, the arrondissement” are deleted;

2° The third paragraph is deleted;

3° In the fourth paragraph, the words: “or in the land register” are deleted.

III.-.For the application of Article L. 511-2 :

1° In the third paragraph of I, the sentence: “The provisions of Articles L. 521-1 to L. 521-4 are then applicable” is deleted;

2° In the fourth paragraph of I, the words: “pursuant to Article L. 521-3-1” are deleted;

3° In the second paragraph of III, the words: “or in the land register” are deleted;

4° The second paragraph of I and IV are deleted.

IV.-.For the application of Article L. 511-4, the words: “as in matters of direct taxation” are replaced by the words: “under the conditions set by the regulations applicable locally in matters of direct taxation”.

V.-For the application of article L. 511-5 :

1° In the first paragraph, the words “under the conditions set out in Articles L. 521-1 to L. 521-3” are deleted;

2° The second paragraph is deleted.

Article L2573-20

I.-Dans leur rédaction résultant de la loi n° 2018-1021 du 23 novembre 2018 portant évolution du logement, de l’aménagement et du numérique, les articles L. 511-1 à L. 511-5 et l’article L. 511-6, à l’exception du V, du code de la construction et de l’habitation sont applicables aux communes de Polynésie française sous réserve des adaptations prévues aux II, III, IV et V.

II.-Pour l’application de l’article L. 511-1-1 :

1° Au deuxième alinéa, les mots : ” ou, à Paris, Marseille et Lyon, de l’arrondissement ” sont supprimés ;

2° Le troisième alinéa est supprimé ;

3° Au quatrième alinéa, les mots : ” ou au livre foncier ” sont supprimés.

III.-Pour l’application de l’article L. 511-2 :

1° Au troisième alinéa du I, la phrase : ” Les dispositions des articles L. 521-1 à L. 521-4 sont alors applicables ” est supprimée ;

2° Au quatrième alinéa du I, les mots : ” en application de l’article L. 521-3-1 ” sont supprimés ;

3° Au deuxième alinéa du III, les mots : ” ou au livre foncier ” sont supprimés ;

4° Le deuxième alinéa du I et le IV sont supprimés.

IV.-Pour l’application de l’article L. 511-4, les mots : ” comme en matière de contributions directes ” sont remplacés par les mots : ” dans les conditions fixées par la réglementation applicable localement en matière de contributions directes “.

V.-Pour l’application de l’article L. 511-5 :

1° Au premier alinéa, les mots : ” dans les conditions prévues aux articles L. 521-1 à L. 521-3 ” sont supprimés ;

2° Le deuxième alinéa est supprimé.
