Article L2573-50 of the French General Code of Local Authorities

For its application in French Polynesia, Article L. 2333-87 reads as follows:

“Art. L. 2333-87 -Without prejudice to the application of article L. 2213-2, the municipal council or the deliberative body of the public establishment for inter-communal cooperation or of the mixed syndicate competent for the organisation of transport, when authorised to do so by its articles of association, may establish a parking fee on roads that it determines. Where the public domain in question falls under the authority of another local authority, the latter’s assent is required outside built-up areas.
The decision establishes the tariffs applicable to each paid parking zone.

“The tariff may be modulated according to the number of parking spaces.
“The rate may vary according to the length of the parking period. It may also include a free section for a specified period. The deed instituting the charge may provide for specific pricing for certain categories of users and in particular residents. “

“ Art. L. 2333-87.-Sans préjudice de l’application de l’article L. 2213-2, le conseil municipal ou l’organe délibérant de l’établissement public de coopération intercommunale ou du syndicat mixte compétent pour l’organisation des transports, lorsqu’il y est autorisé par ses statuts, peut établir sur des voies qu’il détermine une redevance de stationnement. Dans le cas où le domaine public concerné relève d’une autre collectivité, l’avis conforme de cette dernière est requis hors agglomération.

“ La délibération établit les tarifs applicables à chaque zone de stationnement payant.

“ Le tarif peut être modulé en fonction de la durée du stationnement. Il peut prévoir également une tranche gratuite pour une durée déterminée. L’acte instituant la redevance peut prévoir une tarification spécifique pour certaines catégories d’usagers et notamment les résidents. ”
