Article L2573-52 of the French General Code of Local Authorities

I. – Articles L. 2334-1 and L. 2334-2, article L. 2334-7, with the exception of the second paragraph of 3°, the last paragraph of 4° and 5° of I, Articles L. 2334-8 and L. 2334-10 à L. 2334-12, the first three paragraphs of article L. 2334-13 and I and II of Article L. 2334-14-1 are applicable to the communes of French Polynesia subject to the adaptations provided for in II and III.

II. – For the application of Article L. 2334-2, the second paragraph is worded as follows:

“This population is the total population increased, unless otherwise provided, by one inhabitant per secondary residence. “

III. – For the application of the fourth and fifth paragraphs of Article L. 2334-13, the quota intended for the communes of French Polynesia is calculated by applying to the quota intended for the overseas communes, which was determined by applying the ratio existing, on the date of the last general census, between the population of the overseas communes increased by 35% and the French population, the ratio existing, on the same date, between the population of French Polynesia and that of the overseas communes.

I. – Les articles L. 2334-1 et L. 2334-2, l’article L. 2334-7, à l’exception du deuxième alinéa du 3°, du dernier alinéa du 4° et du 5° du I, les articles L. 2334-8 et L. 2334-10 à L. 2334-12, les trois premiers alinéas de l’article L. 2334-13 et les I et II de l’article L. 2334-14-1 sont applicables aux communes de la Polynésie française sous réserve des adaptations prévues aux II et III.

II. – Pour l’application de l’article L. 2334-2, le deuxième alinéa est rédigé comme suit :

” Cette population est la population totale majorée, sauf disposition contraire, d’un habitant par résidence secondaire. “

III. – Pour l’application des quatrième et cinquième alinéas de l’article L. 2334-13, la quote-part destinée aux communes de Polynésie française est calculée en appliquant à la quote-part destinée aux communes d’outre-mer, laquelle a été déterminée par l’application du rapport existant, à la date du dernier recensement général, entre la population des communes d’outre-mer majorée de 35 % et la population française, le rapport existant, à la même date, entre la population de la Polynésie française et celle des communes d’outre-mer.
