Article L2681-4 of the French Public procurement code

For the application of the legislative provisions of Book III in the French Southern and Antarctic Territories:
1° Article L. 2311-1 reads as follows:

“Art. L. 2311-1 -The provisions of Chapter I of Title I of Book I, with the exception of Article L. 2111-3 , shall apply. ” ;

2° In Article L. 2313-2, the words: “or a public body of the European Union” are deleted;
3° In Article L. 2313-3, the words: “or the objectives of Directive 2009/81/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, supply contracts and service contracts by contracting authorities or entities in the fields of defence and security, and amending Directives 2004/17/EC and 2004/18/EC,” are deleted;
4° In Article L. 2341-1, the references to articles 1741 to 1743, 1746 and 1747 of the General Tax Code are replaced by references with the same purpose applicable locally and the words: “, as well as for equivalent offences under the legislation of another Member State of the European Union” are deleted;
5° In article L. 2342-2, the words: “outside the territory of the European Union” are replaced by the words: “in a third country”;
6° The first paragraph of Article L. 2353-1 reads as follows:
“Defence or security contracts are awarded to economic operators from Member States of the European Union. “;
7° The second paragraph of Article L. 2371-1 reads as follows:
“The provisions of articles L. 2171-2 , L. 2171-1 to L. 2171-5 and L. 2171-7 then apply to these contracts. “;
8° The first paragraph of Article L. 2395-1 reads as follows:
“The purchaser may terminate the defence or security contract in the cases provided for in Articles L. 2195-2 and L. 2195-3. “.

Pour l’application des dispositions législatives du livre III dans les Terres australes et antarctiques françaises :
1° L’article L. 2311-1 est ainsi rédigé :

” Art. L. 2311-1.-Les dispositions du chapitre Ier du titre Ier du livre Ier, à l’exception de l’article L. 2111-3 s’appliquent. ” ;

2° A l’article L. 2313-2, les mots : ” ou un organisme public de l’Union européenne ” sont supprimés ;
3° A l’article L. 2313-3, les mots : ” ou les objectifs de la directive 2009/81/ CE du Parlement européen et du Conseil du 13 juillet 2009 relative à la coordination des procédures de passation de certains marchés de travaux, de fournitures et de services par les pouvoirs adjudicateurs ou entités adjudicatrices dans les domaines de la défense et de la sécurité, et modifiant les directives 2004/17/ CE et 2004/18/ CE, ” sont supprimés ;
4° A l’article L. 2341-1, les références aux articles 1741 à 1743,1746 et 1747 du code général des impôts sont remplacées par les références ayant le même objet applicables localement et les mots : “, ainsi que pour les infractions équivalentes prévues par la législation d’un autre Etat membre de l’Union européenne ” sont supprimés ;
5° A l’article L. 2342-2, les mots : ” hors du territoire de l’Union européenne ” sont remplacés par les mots : ” dans un Etat tiers ” ;
6° Le premier alinéa de l’article L. 2353-1 est ainsi rédigé :
” Les marchés de défense ou de sécurité sont passés avec des opérateurs économiques d’Etats membres de l’Union européenne. ” ;
7° Le second alinéa de l’article L. 2371-1 est ainsi rédigé :
” Les dispositions des articles L. 2171-2 L. 2171-1à L. 2171-5 et L. 2171-7 s’appliquent alors à ces marchés. ” ;
8° Le premier alinéa de l’article L. 2395-1 est ainsi rédigé :
” L’acheteur peut résilier le marché de défense ou de sécurité dans les cas prévus aux articles L. 2195-2 et L. 2195-3. “.
