Article L311-43 of the French Insurance Code

The trustee shall regularly report on the management of the liability management structure to the collège de résolution, in accordance with the procedures defined by the latter. By way of derogation from article 2022 of the French Civil Code, the trust agreement may stipulate that the trustee is not accountable to the settlor for the performance of its duties.

In the performance of its duties, the trustee has no obligation or liability to the holders of equity or other ownership interests or to the creditors of the person subject to the resolution procedure.

Le fiduciaire rend régulièrement compte de la gestion de la structure de gestion de passifs au collège de résolution, selon des modalités définies par ce dernier. Par dérogation à l’article 2022 du code civil, le contrat de fiducie peut prévoir que le fiduciaire ne rend pas compte de sa mission au constituant.


Dans l’exercice de ses missions, le fiduciaire n’a aucune obligation ni aucune responsabilité à l’égard des détenteurs de titres de capital ou d’autres titres de propriété et des créanciers de la personne soumise à la procédure de résolution.
