The allocation of financial aid from the Centre national du cinéma et de l’image animée is subject to the inclusion in the contracts concluded with the authors of cinematographic and audiovisual works submitted in support of an application for aid of standard clauses ensuring respect for the moral rights granted to authors by articles L. 121-1 and L. 121-5 of the Intellectual Property Code and the principles set out in articles L. 131-4 and L. 132-25 of the same code relating to the determination of their remuneration. These standard clauses are drawn up by agreement between the professional authors’ organisations or the collective management organisations mentioned in Title II of Book III of the said code and the professional organisations representing producers. In the absence of an agreement within one year of the publication oforder no. 2020-1642 of 21 December 2020, a decree in the Conseil d’Etat will set the standard clauses.
By way of derogation from the previous paragraph, the Centre national du cinéma et de l’image animée may also award financial assistance when the applicant establishes that the author with whom the contract submitted in support of the application for assistance is concluded is an author of foreign nationality domiciled outside French territory and that this author is imperatively subject to regulations that are incompatible with the inclusion of standard clauses ensuring compliance with the provisions and principles mentioned in the previous paragraph.
