Chapter I: General provisions

The financial aid from the Centre national du cinéma et de l’image animée mentioned in a and b of 2° of article L. 111-2 are awarded on an automatic or selective basis.

Proceeds from the tax on ticket prices for screenings organised in cinematographic establishments mentioned in article L. 115-1, collected on the occasion of the showing of cinematographic or audiovisual works or documents of a pornographic nature or inciting to violence, are not taken into account when calculating entitlement to automatic aid. The aforementioned works and documents and the cinemas where they are shown are not eligible for any selective aid….

The Centre national du cinéma et de l’image animée shall ensure, particularly with regard to employment in the production sector, that beneficiaries of financial aid comply with their social obligations. To this end, the Centre national du cinéma et de l’image animée may request from applicants for financial aid any document proving compliance with these obligations.

When the Centre national du cinéma et de l’image animée becomes aware of a report pursuant to articles L. 413-1 and L. 413-2, it may suspend or refuse the granting of aid or, where appropriate, demand that it be repaid.

The allocation of financial aid from the Centre national du cinéma et de l’image animée is subject to the inclusion in the contracts concluded with the authors of cinematographic and audiovisual works submitted in support of an application for aid of standard clauses ensuring respect for the moral rights granted to authors by articles L. 121-1 and L. 121-5 of the Intellectual Property Code and the principles set out in…
