Article L3114-1 of the French General Code of Local Authorities

I. – Several départements in the same region forming a single territory may, by joint decision of their departmental councils, adopted by a majority of three-fifths of the votes cast, request to be grouped together to form a single département. The opinion of the relevant Comité de Massif is required if one of the departments concerned includes mountain areas within the meaning of article 3 of law no. 85-30 of 9 January 1985 on the development and protection of mountain areas. Its opinion is deemed to be favourable if it has not given its opinion by the end of a period of four months following notification by the State representative of the deliberations of the departmental councils concerned.

As an exception to articles L. 3121-9 and L. 3121-10, the request for the grouping of départements provided for in the first paragraph is placed on the agenda of the departmental council on the initiative of at least 10% of its members.

Article L3114-1

I. – Plusieurs départements formant, dans la même région, un territoire d’un seul tenant peuvent, par délibérations concordantes de leurs conseils départementaux, adoptées à la majorité des trois cinquièmes des suffrages exprimés, demander à être regroupés en un seul département. L’avis du comité de massif compétent est requis dès lors que l’un des départements intéressés comprend des territoires de montagne au sens de l’article 3 de la loi n° 85-30 du 9 janvier 1985 relative au développement et à la protection de la montagne. Son avis est réputé favorable s’il ne s’est pas prononcé à l’expiration d’un délai de quatre mois suivant la notification par le représentant de l’Etat des délibérations des conseils départementaux intéressés.

Par dérogation aux articles L. 3121-9 et L. 3121-10, la demande de regroupement de départements prévue au premier alinéa est inscrite à l’ordre du jour du conseil départemental à l’initiative d’au moins 10 % de ses membres.
