Article L3116-3 of the French Public Health Code

The officials mentioned in the second paragraph of article L. 3115-1, responsible for health checks at borders, authorised and sworn under the conditions laid down by decree in the Conseil d’Etat, are authorised to investigate and record offences relating to health checks at borders. To this end, these officers have the prerogatives mentioned in articles L. 1421-2 and L. 1421-3.

Reports drawn up by these officers are authentic until proven otherwise.

Article L3116-3

Ont qualité pour rechercher et constater les infractions en matière de contrôle sanitaire aux frontières, les agents mentionnés au deuxième alinéa de l’article L. 3115-1, chargés du contrôle sanitaire aux frontières, habilités et assermentés dans les conditions fixées par décret en Conseil d’Etat. Ces agents disposent à cet effet des prérogatives mentionnées aux articles L. 1421-2 et L. 1421-3.

Les procès-verbaux dressés par ces agents font foi jusqu’à preuve contraire.
