The Association française des établissements de crédit et des entreprises d’investissement (French Association of Credit Institutions and Investment Firms), referred to in Article L. 511-29, adopts a charter for banking inclusion and the prevention of overindebtedness, approved by order of the Minister for the Economy, after consultation with the Comité consultatif du secteur financier (Financial Sector Consultative Committee) and the Comité consultatif de la législation et de la réglementation financières (Financial Legislation and Regulation Consultative Committee). This charter applies to all credit institutions. Compliance with the charter is monitored by the Autorité de contrôle prudentiel et de résolution and is subject to the procedure set out in article L. 612-31.
The purpose of this charter is to improve access to banking services and to facilitate the use of these services, in particular as regards means of payment, for natural persons not acting for professional purposes. It is also intended to help prevent over-indebtedness among these individuals.
In particular, this charter specifies the procedures for informing customers concerned by the offers mentioned in the second paragraph of article L. 312-1-3. It also specifies the training and awareness-raising activities carried out by credit institutions to promote the distribution of these offers to the people concerned.
This charter also defines the conditions under which each credit institution has a system for the early detection of situations of financial fragility among its customers and provides appropriate responses to these situations, in consultation with the customer concerned.
