Article L312-16 of the French Consumer Code

Before entering into the credit agreement, the creditor checks the borrower’s creditworthiness on the basis of sufficient information, including information provided by the borrower at the request of the creditor. The creditor shall consult the file provided for in article L. 751-1, under the conditions set out in the order referred to in article L. 751-6, except in the case of a transaction referred to in 1 of article L. 511-6 or in 1 du I de l’article L. 511-7 du code monétaire et financier.

Avant de conclure le contrat de crédit, le prêteur vérifie la solvabilité de l’emprunteur à partir d’un nombre suffisant d’informations, y compris des informations fournies par ce dernier à la demande du prêteur. Le prêteur consulte le fichier prévu à l’article L. 751-1, dans les conditions prévues par l’arrêté mentionné à l’article L. 751-6, sauf dans le cas d’une opération mentionnée au 1 de l’article L. 511-6 ou au 1 du I de l’article L. 511-7 du code monétaire et financier.
