Article L3121-14 of the French General Code of Local Authorities

The departmental council may not deliberate unless an absolute majority of its members in office are present.

However, if, on the day fixed by the notice convening the meeting, the departmental council does not meet in sufficient number to deliberate, the meeting is held ipso jure three days later and the deliberations are then valid regardless of the number of those present.

Subject to the provisions of articles L. 3122-1 and L. 3122-5, deliberations of the departmental council are taken by a majority of the votes cast.

Le conseil départemental ne peut délibérer si la majorité absolue de ses membres en exercice n’est présente.

Toutefois si, au jour fixé par la convocation, le conseil départemental ne se réunit pas en nombre suffisant pour délibérer, la réunion se tient de plein droit trois jours plus tard et les délibérations sont alors valables quel que soit le nombre des présents.

Sous réserve des dispositions des articles L. 3122-1 et L. 3122-5, les délibérations du conseil départemental sont prises à la majorité des suffrages exprimés.
