Article L3121-8 of the French General Code of Local Authorities

The departmental council draws up its own rules of procedure within three months of its renewal. The rules of procedure previously adopted continue to apply until the new rules of procedure are drawn up. The rules of procedure determine the rights of duly constituted elected groups and the specific rights of minority groups or those that have declared themselves to be in opposition. The rules of procedure may be referred to the administrative court.

Le conseil départemental établit son règlement intérieur dans les trois mois qui suivent son renouvellement. Le règlement intérieur précédemment adopté continue à s’appliquer jusqu’à l’établissement du nouveau règlement. Le règlement intérieur détermine les droits des groupes d’élus régulièrement constitués et les droits spécifiques des groupes minoritaires ou s’étant déclaré d’opposition. Le règlement intérieur peut être déféré devant le tribunal administratif.
