Article L3121-9 of the French Labour Code

A period of on-call duty is defined as a period during which the employee, without being at his place of work and without being permanently and immediately available to the employer, must be able to intervene to carry out work for the company.

The duration of this intervention is considered as actual working time.

The period of on-call duty is compensated either financially or in the form of time off.

Employees affected by periods of on-call duty are informed of their individual schedule within a reasonable period of time.

Une période d’astreinte s’entend comme une période pendant laquelle le salarié, sans être sur son lieu de travail et sans être à la disposition permanente et immédiate de l’employeur, doit être en mesure d’intervenir pour accomplir un travail au service de l’entreprise.

La durée de cette intervention est considérée comme un temps de travail effectif.

La période d’astreinte fait l’objet d’une contrepartie, soit sous forme financière, soit sous forme de repos.

Les salariés concernés par des périodes d’astreinte sont informés de leur programmation individuelle dans un délai raisonnable.
