Article L3123-5 of the French General Code of Local Authorities

The time of absence provided for in articles L. 3123-1 and L. 3123-2 is treated as an actual period of work for the purposes of determining the period of paid leave as well as with regard to all rights arising from seniority.

Moreover, no change may be made to the duration or hours of work provided for in the employment contract as a result of absences incurred pursuant to the provisions of articles L. 3123-1 and L. 3123-2 without the agreement of the elected representative concerned.

Le temps d’absence prévu aux articles L. 3123-1 et L. 3123-2 est assimilé à une durée de travail effective pour la détermination de la durée des congés payés ainsi qu’au regard de tous les droits découlant de l’ancienneté.

Aucune modification de la durée et des horaires de travail prévus par le contrat de travail ne peut, en outre, être effectuée en raison des absences intervenues en application des dispositions prévues aux articles L. 3123-1 et L. 3123-2 sans l’accord de l’élu concerné.
