Article L3131-1 of the French General Code of Local Authorities

I. – The acts adopted by the departmental authorities are enforceable by operation of law as soon as they have been brought to the attention of the interested parties in accordance with the conditions set out in this article and, for the acts mentioned in article L. 3131-2, as soon as they have been transmitted to the representative of the State in the department in accordance with this article.

III.-Les actes réglementaires et les décisions ne présentant ni un caractère réglementaire, ni un caractère individuel font l’objet d’une publication sous forme électronique, dans des conditions fixées par décret en Conseil d’Etat, de nature à garantir leur authenticité et à assurer leur mise à disposition du public de manière permanente et gratuite.


IV.-En cas d’urgence, un acte devant, en vertu des dispositions du III, faire l’objet d’une publication par voie électronique entre en vigueur dès qu’il a été procédé à son affichage et, s’il est soumis aux dispositions de l’article L. 3131-2, à sa transmission au représentant de l’Etat dans le département.


Il est néanmoins procédé dans les meilleurs délais à la publication normalement requise, qui peut seule faire courir le délai de recours contentieux.


V.-Lorsqu’une personne demande à obtenir sur papier un acte publié sous forme électronique, le président du conseil départemental le lui communique. Il n’est pas tenu de donner suite aux demandes abusives, en particulier par leur nombre ou par leur caractère répétitif ou systématique.
