When the concession-granting public entity terminates the works concession contract or the public service concession contract before its normal expiry date, the operator is entitled to compensation for the loss it suffers as a result of the early return of the assets, free of charge, to the assets of the public entity if they have not been fully depreciated, under the following conditions :
1° When the depreciation of these assets has been calculated on the basis of a useful life of less than the term of the contract, the compensation to which the concessionaire is entitled is equal to the net book value of the assets;
2° When the depreciation of these assets has been calculated on the basis of a useful life of more than the term of the contract, the compensation to which the concessionaire is entitled is equal to the net book value of the assets as it would result from their depreciation over the term of the contract.
The compensation payable by the public entity may not exceed the amount calculated under the previous paragraphs.
