Article L3141-1 of the French General Code of Local Authorities

For the preparation and execution of the deliberations of the departmental council , its chairman may call upon the services of decentralised government departments as required. The president of the departmental council issues all necessary instructions directly to the heads of department for the execution of the tasks he entrusts to the said departments. He supervises the execution of these tasks.

He may, under his supervision and responsibility, delegate his signature to the heads of the said services for the performance of the tasks he entrusts to them in application of the preceding paragraph.

A decree in the Conseil d’Etat shall set the terms and conditions for making these departments available.

Article L3141-1

Pour la préparation et l’exécution des délibérations du conseil départemental , son président peut disposer, en tant que de besoin, de services déconcentrés de l’Etat. Le président du conseil départemental adresse directement aux chefs de service toutes instructions nécessaires pour l’exécution des tâches qu’il confie auxdits services. Il contrôle l’exécution de ces tâches.

Il peut, sous sa surveillance et sa responsabilité, donner délégation de signature aux chefs desdits services pour l’exécution des missions qu’il leur confie en application de l’alinéa précédent.

Un décret en Conseil d’Etat fixe les conditions et les modalités de la mise à disposition de ces services.
