Article L3142-109 of the French Labour Code

At the end of the leave or period of part-time work, if the employee wishes to terminate the employment relationship, the conditions of termination are those set out in his employment contract, with the exception of those relating to notice. The employee is therefore exempt from paying a termination indemnity.

The employee may not invoke any right to be re-employed before the expiry of the leave.

A l’issue du congé ou de la période de travail à temps partiel, si le salarié souhaite mettre fin à la relation de travail, les conditions de la rupture sont celles prévues par son contrat de travail, à l’exception de celles relatives au préavis. Le salarié est, de ce fait, dispensé de payer une indemnité de rupture.

Le salarié ne peut invoquer aucun droit à être réemployé avant l’expiration du congé.
