Article L3142-41 of the French Labour Code

In the absence of an agreement referred to in Article L. 3142-40, the following provisions apply:

1° The maximum number of days that may be taken as leave is nine working days per year;

2° The time limit within which the employee must inform the employer of his request for leave is set by decree;

3° The rules for determining, per establishment, the maximum number of employees who may benefit from this leave in the course of a year are defined by decree in the Conseil d’Etat.

A défaut de convention ou d’accord mentionné à l’article L. 3142-40, les dispositions suivantes sont applicables :

1° Le nombre maximal de jours pouvant être pris au titre du congé est de neuf jours ouvrables par an ;

2° Le délai dans lequel le salarié informe l’employeur de sa demande de congé est fixé par décret ;

3° Les règles selon lesquelles est déterminé, par établissement, le nombre maximal de salariés susceptibles de bénéficier de ce congé au cours d’une année sont définies par décret en Conseil d’Etat.
