Article L3142-95 of the French Labour Code

The employment contract of an employee called up for national service in application of Book II of the National Service Code is suspended for the duration of active national service.

When they know the date of their release from active national service, and at the latest within one month of this date, employees wishing to return to the job they previously held must inform their former employer.

Reinstatement in the company is automatic.

The reinstated employee benefits from all the advantages acquired at the time of his departure.

Le contrat de travail d’un salarié appelé au service national en application du livre II du code du service national est suspendu pendant toute la durée du service national actif.

Lorsqu’il connaît la date de sa libération du service national actif, et au plus tard dans le mois suivant celle-ci, le salarié désirant reprendre l’emploi qu’il occupait précédemment en avertit son ancien employeur.

La réintégration dans l’entreprise est de droit.

Le salarié réintégré bénéficie de tous les avantages acquis au moment de son départ.
